These Terms of Service ("Terms") govern your access to and use of the website and services operated by Ashmont Capital Advisors ("Ashmont Capital Advisors," "we," "us," or "our"). By accessing this website or submitting an inquiry, you agree to be bound by these Terms. If you do not agree, please do not use our site or services.

1. Description of Services

Ashmont Capital Advisors provides commercial financing to business entities, including merchant cash advances, short-term business loans, business lines of credit, and equipment financing, in amounts generally ranging from $10,000 to $500,000. We are a direct lender and fund approved applications with our own capital. Where an applicant is better served by a structure or facility size other than what we hold, we arrange financing through our network of third-party funding partners and disclose that arrangement to the applicant before any agreement is signed. Ashmont Capital Advisors is not a bank, does not accept deposits, and does not offer consumer loans. All financing is offered for commercial purposes only to business entities, and is subject to underwriting approval. Approved amounts, rates, fees, factor rates, payment schedules, and terms vary by applicant and are disclosed in writing before any agreement is executed. Submitting an application does not constitute an offer of financing, an approval, or a commitment to fund. No financing is binding until a written agreement is executed by both parties.

2. Eligibility

To apply for financing, you must:

• Be at least 18 years of age.
• Be an authorized representative, owner, or officer of a legally operating U.S.-based business, and be authorized to bind that business.
• Provide accurate, complete, and truthful information in your application, financial documentation, and all communications.
• Not use our services for any unlawful or fraudulent purpose.

3. Application and Information Accuracy

You represent and warrant that all information submitted to Ashmont Capital Advisors is accurate, current, and complete. Providing false, misleading, or incomplete information may result in denial of your application, termination of any existing financing agreement, and may constitute fraud subject to civil or criminal penalties. Ashmont Capital Advisors reserves the right to verify any information provided.

4. SMS and Electronic Communications

ASHMONT CAPITAL ADVISORS LLC (doing business as Ashmont Capital Advisors) sends SMS/text messages only to applicants who have affirmatively opted in by checking a consent box on our application form at https://ashmontcapitaladvisorsgroup.com/contact-1/. The form has two separate, unchecked consent boxes: one for non-marketing messages about your funding application (appointment confirmations, reminders, application status updates, and requests for documents needed to underwrite your file), and one for marketing and promotional messages about our financing products, rates, and offers. SMS consent is optional and is never a condition of applying for or receiving financing, and neither box is required to submit the form. You will receive up to approximately 10 messages per month. Message and data rates may apply. You can cancel the SMS service at any time by texting "STOP" to (617) 415-3388, and we will send a confirmation that you have been unsubscribed. For help, reply HELP or contact us at [email protected]. Carriers are not liable for delayed or undelivered messages. We do not purchase, rent, or import phone numbers from third parties. 5. Intellectual Property

All content on this website — including text, graphics, logos, and software — is the property of Ashmont Capital Advisors or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

• Submit false or fraudulent information.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ASHMONT CAPITAL ADVISORS AND ASHMONT CAPITAL ADVISORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF — OR INABILITY TO USE — OUR WEBSITE OR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

9. Indemnification

You agree to indemnify, defend, and hold harmless Ashmont Capital Advisors, its officers, directors, employees, and agents from any claims, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of our services shall be resolved through binding arbitration in Miami-Dade County, Florida, in accordance with the rules of the American Arbitration Association, except where prohibited by applicable law.

Ashmont Capital Advisors reserves the right to update these Terms at any time. Material changes will be posted on this page with a revised date. Continued use of our website after changes are posted constitutes acceptance of the updated Terms.
